Street Smarts: Want to get back at unwanted telemarketers? Sue ‘em!
Attorney Steve Ostrow takes great pleasure in busting telemarketers and people who send junk faxes. He’s sued and won ten lawsuits and he’s written a step-by-step to guide to make it easier for the rest of us to sue telemarketers.
His new book How To Sue A Telemarketer – A Guide to Creating Peace On Earth One Telephone Call At A Time assembles and simplifies the very best strategies and tactics that the average citizen can use to minimize telemarketer intrusions. He explains everything a person needs to do to take a relentless telemarketer to small-claims court.
“Unwanted telemarketing calls and faxes can be fun and profitable,” says attorney Steve Ostrow. “It’s actually pretty easy to take them to court and win.”
Ostrow says that to get telemarketers to stop calling you the first and most important thing to do is to get on the U.S. Government’s Do Not Call Registry operated by the Federal Trade Commission at WWW.DONOTCALL.GOV or call toll-free, 1-888-382-1222 (TTY 1-866-290-4236). The key is to call from the number you wish to register, regardless of whether it is a landline or a cell phone. Registration is free.
Then the next time a telemarketer calls, If all you you’re looking to do is get the telemarketer to stop calling you, once you have them on the line simply say “Place me on your no call list” and then hang up. To a legitimate telemarketer, these magic words inspire instant compliance and they know they cannot return calls without facing legal repercussions.
“The real fun,” this high energy litigator says, “begins 31 days after your phone has been on the Do Not Call Registry and you get another unwanted call from a telemarketer. That’s when you can take them to court for calling you”.
Ostrow says that to prevail in small claims court, you need to acquire some crucial information.
Ostrow advises that instead of letting a telemarketer go through their script, interrupt them and say “excuse me, can I ask you for some information?” Then as quick as you can, get the name of person calling, the name of the organization they are calling from, their address and phone, and what they are trying to sell you.
Then you then need to do a little bit of research to verify the legal name of the telemarketer.
“The toughest thing a person has to do is to get the proper legal name and address,” Ostrow says. This can usually be done by calling the company, searching on the Internet, and checking with the appropriate State Department of Revenue or Licensing or the County Recorder’s Office.
Once you have that you can file a small claims action and serve the papers – usually by certified mail. Voila! You don’t even need an attorney. In fact, lawyers aren’t allowed in small claims court.
If you’ve done your homework, you’ll win your case. Under the Telephone Consumer Protection Act a judge can award $500 for each violation and you can even seek multiple violations all at the same time.
“Sometimes, even just filing a small claims court action will result in a call and an offer to settle for the full amount,” Ostrow said.

Unlike his counterpart Mike Tyson who was at the time of the allegations against him for domestic violence the world heavy weight boxing champ, Tito Ortiz competes in what is arguably one of the most violent sport known to man!
His job to pulverize his opponants. Have you ever shaken a fighter’s hand? I did several times and swore that I would not ever be able to use my right hand again, and that was during a friendly greeting! IMAGINE what would happen if they had been PISSED off? Would I believe that Tito grabbed Jenna by the arm? Certainly! Do I believe he “HIT” her as the reports are stating. HELL NO!
Think about it people. This is a man who does nothing all day but hit people, punches bags weighing 200 – 300# for HOURS! Even if he pimp slapped this woman he would have broken EVERY bone in her face!
In my prime at 5′ 9″ 195# I would pack enough power into a punch that I have literally crushed people’s eye sockets, broken jaws, cheek bones and of course noses. And these were grown ass large MEN! What do you think I would do if I hit a small woman? Pretty much take her head clear off.
Keep in mind people Titos bicep alone is probably bigger than Jenna’s head! And before you all jump on the persecute Tito bandwagon like so many did to Tiger Woods, remember. NONE of us were there as witnesses to the event. Also keep in mind the simple fact that Tito is a PROFESSIONAL fighter who is in effect a human lethal weapon.

Arizona Immigration Law – WTF?
Ok just so you know, I am writing this without the approval of my editor in chief and against the advice of legal. But I simply have a need to scream out against injustice where ever I might find it! Ok, perhaps it’s nothing as noble as that. Perhaps it’s simply I have a SERIOUS aversion to S-T-U-P-I-D-I-T-Y!
As many of you may have become frightfully aware of Arizona’s anti-illegal immigration Senate Bill SB1070 which was passed by a largely republican state legislature On Monday April 19 2010. This should be a hot topic for many reasons just some of which I’ll cover here.
First off this SB1070 hands police the broad power to check the legal status of anyone they “reasonably” suspect are illegal immigrants. Someone PLEASE explain to me what REASONABLY means. Is that like all the times I’ve been stopped by “white” officers in the O.C while traveling because “I look like someone they’re looking for in connection with some recent crime!” Or as I say because “I look like every other black man in America accused of some crime!”
While I tend to shy away from playing the “race card” SB1070 unfortunately lends itself to just that! The bill continues also forbids cities from adopting sanctuary policies which restrict police and public workers from immigration enforcement.
What I find most interesting about this situation is that in all reality it targets one specific group. And that group is our neighbors south of the border, who incidentally were already here long before the colonists got here! But that is a discussion for another time! The point at hand is how this bill allows for racial profiling to the extreme! NO hispanic looking person or person overheard speaking a foreign languange is safe from rampant police harrassment!
Erin Burnett of CNBC said that businesses, which usually clamor for more immigrants, would not push back against the Arizona law because, she said, Arizona is a state of Hispanic immigrants — not the immigrants that business wants.
“They want the Indian immigrant, the Korean immigrant, the Chinese immigrant, but not the Hispanic immigrant,” she said, without elaborating but implying that Hispanic immigrants are not educated enough or skilled enough. She was being honest, reporting what she has been told and has heard
Really? Some of these immigrants are highly skilled in the arts, labor, construction, auto repair and the list goes on and on! So in effect this well respected reporter is buying into the outrageous stereotype that illegal immigrants are stupid and unworthy of an opportunity at a better quality of life!
Before any of you even think about fixing your mouth to make the statement that they should come into the country legally and get their citizenship let me stop you! Have you ever really looked into the excessive financial BURDEN it is to become a citizen of this country these days? It’s staggering. You could buy a Mercedez Benz cash for what the total cost of becoming a citizen is.
The government doesn’t make it easy or financially viable for most individuals to even get a visa, yet somehow members of terrorist organizations seem to have ZERO problems getting visas to enter, live, and work in this country, not to mention get educated at our top schools. Explain that one to me!
Another statement that makes me want to reach out and slap someone is the statement that “They’re taking our jobs!” Yes they sure are taking ALL of jobs. I was totally crushed, had my car repo’d, my house foreclosed on and my dog left me when I lost my job picking strawberrys, lettuce, tomatos, etc to an “Illegal Immigrant”! Really America? Will you really go do those jobs?
You NEED these people doing those jobs because they keep your produce and strawberries and all the ground grown products you love so much affordable. Imagine if we had to pay someone minimum wage even to pick strawberries how a little basket of strawberries would be? You wouldn’t afford it. Enter Juan Q. Publico, he’ll pick those strawberries for what amounts to like $0.25 per bundle so you can still afford to buy them.
Another fun statemtent is “Those people get paid under the table so they don’t pay taxes.” I scream at the top of my lungs – BULLSH*T!!!!” These immigrants buy taxable products, cigarettes, booze, fuel, food. The go out to movies, restaurants, keeping other people employed by the way. So they pay taxes. Those who get falsified documentation to work menial jobs still have taxes taken out of their checks that they will never see returns from.
These are for the most part not the people coming here commiting many of the violent crimes of selling of the drugs. They’re in fact trying to stay as far away from law enforcement as humanly possible lest they be discovered and deported.
These people are putting their children into our public schools in the hopes that these children will learn and reach heights thier parents had only dreamt of!
America and Americans need to remember that this is a country founded by ILLEGAL IMMIGRANTS for ILLEGAL IMMIGRANTS! Why now are we crying about these people. I’m not saying that we just open the doors and leave the store unattended but let’s be reasonable. There are REAL crimes going on that affect people on a daily basis to tie up the time of our law enforcement officials which such racist activity!
Oh and Steve Poizner – Illegal immigrants from south of the border are NOT responsible for the economic crisis that California is in anymore than you are a reasonable, un-biggoted and educated man! Get a clue man! Irresponsible SPENDING like tearing up perfectly good freeways to fix them with substandard materials is responsible for the econimic crisis California is in.
Along with the ridiculous taxation on businesses which have caused them to leave the state or worse outsource to India or where ever they go, that’s put hundreds of thousands if not millions of Californians out of work! Want a stronger economy then bring big business back to California. Give them a tax free option to relocate and headquarter in California, so they can employ thousands of people here in the state and bring self worth and dignity back to willing hard working people.
It’s this type of moronic post HitlerNazi style fascist finger pointing that we saw shortly after 9/11. First rule of America – Blame everyone else rather than our own stupidity.
I HATE the California DMV

Ok so here it is. I have a truck to register, to add to the High Speed Magazine motorpool. It’s a truck that’s going to be getting wrapped with the company logo, website and of course feature the Five High Speed Divas for 2010!
Of course we’re not talking about a brand new truck or anything in fact this one is about 14 years old and I pretty much inherited it when my brother Joe passed away in January. But that isn’t the reason you’re reading this.
The reason you’re reading this is to find out why I would HATE the DMV! Well if you’ve never gotten a license or had to register a car in the state of California I wouldn’t expect you to actually know or understand. The California DMV SUCKS!!!
Really what useful purpose does the DMV actually serve? In Cali the DMV is closed THREE Friday’s out of the month and only open on the LAST Friday of the month, and they also aren’t open on Saturdays anymore either. On CERTAIN days they’re open from 8:00 am – 5:00 pm. On most other days from 9:00am – 5:pm which makes it very difficult for those who work a Monday thru Friday 8 – 5 to get in and get shit done.
Even with an appointment you have to take time off work and wait at the DMV for at least an hour but average FOUR hours to finally be seen. What’s the point of making the appointment. As someone who gets $15.00 an hour to do whatever it is they do that’s up to $60.00 they’ve lost.
Now once you get to the DMV the people that are being PAID to be there act as if they’re bothered by you! WTF? Really? It’s your JOB bitches. You should be smiling because you HAVE a job in this economy.
I digress however. So I find out that the truck is going to cost me $198.00 to transfer title and register. WTF? It’s FOURTEEN years old. Of course I told them the truck was valued at around $500.00 which SHOULD put the registration fees at around $60 – $80 since California penalizes you for having a small pick up truck. But $80.00 max with the transfer fees etc.
Nooooo almost $200.00 just for the REGISTRATION! WTF? And here I thought that extortion was ILLEGAL! I guess it’s only illegal when anyone but the government is doing it!
I get that the state is in economic distress, but then so is the entire freaking country!
Additionally the state of California requires an emissions inspection program, currently referred to as the “Smog Check” program. All because they weren’t in compliance with the 1970 Clean air bill, and began implimenting this in 1982. But if the vehicle has already passed then wouldn’t it be pretty worthless to make someone do it continuously. And does sale of a vehicle which has already passed emissions testing make a difference in it’s emissions standards?
I guess the bottom line of my rant is that how does the DMV get away with charging DOUBLE for registration fees yet provide LESS service? I don’t think that people would so much mind paying a little more if they actually felt as if they were getting something beneficial out of it.
Our roads aren’t any better than they were 20 years ago, Highway Patrol are about some of the most useless of any state I’ve ever been in. I’ve has WA.S.P (Washington State Patrol) officers actually pull over and take me to get gas when my DeLorean ran out because unknown to me the fuel gauge was broken. So the whole Ponch & Jon CHiP’s era must be dead and gone.
Oh and here is ANOTHER kick in the groin. California ALSO has a D.U.I. tax! REALLY? WTF is that about? So is it clear yet by I HATE the DMV?
